The streetcar project remains on track following today's votes by City Council's Budget and Finance Committee, which approved increased capital funding and accountability measures that aim to keep the public informed on the project's progress.
The increased funding was previously proposed by City Manager Milton Dohoney to fix a $17.4 million budget gap. The money will come from more issued debt and pulled funding from various capital projects, including infrastructure improvements around the Horseshoe Casino. Under state law, none of the capital funding could be used for operating budget expenses, such as police and fire.
The accountability measures also require the city administration to report to City Council on the streetcar's progress with a timeline of key milestones, performance measures, an operating plan, staffing assessments and monthly progress reports.
"The progress reports should be easy-to-understand and made available online to ensure transparency and accountability to City Council and to citizens," the motion reads.
Council members Roxanne Qualls, Laure Quinlivan, Chris Seelbach, Yvette Simpson and Wendell Young voted for the measures. Council members P.G. Sittenfeld, Chris Smitherman and Charlie Winburn voted against both. Councilwoman Pam Thomas voted against the funding ordinance, but she abstained from voting on the motion imposing accountability measures.
Qualls, who revealed the accountability measures in a press conference prior to today's committee meeting, said the measures will move the streetcar forward and help keep the public informed.
"I will vote today to continue the streetcar project because we need to continue moving Cincinnati forward," she said. "At the same time, while I remain a supporter, it is with the recognition that it is time for a reboot on the project to instill public confidence in its management."
Smitherman did not seem convinced.
"I believe the administration will be back asking for more money on the streetcar," he claimed, pointing to pending litigation with Duke Energy over who is legally obligated to pay for moving utility lines to accommodate the project.
Smitherman and Sittenfeld also criticized their colleagues for not bringing the accountability measures to a vote earlier in the process.
"You would think seven years ago there would have been a motion like this in front of us," Smitherman said, referencing when City Council first approved the streetcar project.
Among the accountability motion's items is an operating plan, which streetcar critics have long demanded.
The city administration estimates operating the streetcar will cost about $3.5 million a year, indicating in the past that casino tax revenue would be used to pay for the costs.
Supporters say those costs will be outweighed by the city's estimated three-to-one return on investment for the streetcar project — an estimate backed by studies from advising company HDR and the University of Cincinnati.
Simpson in particular argued the costs will be made up through increased revenue as the streetcar brings in more businesses and residents to Cincinnati.
Still, Simpson says those estimates don't matter to streetcar opponents.
"If it was $5, there would be individuals who don't support this project," she said.
Winburn responded by saying he supports the streetcar as a concept, which roused laughter from streetcar supporters in the audience. Throughout the project's many hearings, opponents of the streetcar have often said they support streetcars as a concept — at least until they have to put their support to a vote or commit funding.
Still, Winburn added, "Even if you all are wrong, I want to commend you for fighting for what you believe in."
The streetcar project's $17.4 million budget gap is a result of construction bids coming in $26 million to $43 million over budget — a result of "errors in bid documents," according to Qualls.
Besides increasing funding, the city is also hiring John Deatrick, project manager of The Banks, to head the streetcar project. Multiple city officials, including Qualls and Quinlivan, have praised Deatrick for his ability to bring down project costs and put large projects on track.
The funding currently set for the streetcar will only go to the first phase of the project. The final plan calls for tracks stretching from The Banks to the Cincinnati Zoo.
"If the intent of the streetcar would only be to go from The Banks to just north of Findlay Market, then I never would have said it's a project worth doing," Dohoney previously told City Council. "The intention has always been to connect the two major employment centers of the city and go beyond that."
But Smitherman says talk of another phase is financially irresponsible: "I want to indicate to the public that they (the city administration) don't have a budget for the second leg."
The funding ordinance and accountability motion must now be approved by a full session of City Council, which has the same voting make-up as the Budget and Finance Committee.
If it's approved, the federal government has committed another $5 million to the streetcar that will help restore certain aspects of the project previously cut because of budget concerns.

On Monday, the Budget and Finance Committee approved the measures, which CityBeat covered in further detail here. The funding ordinance closes the streetcar project's $17.4 million budget gap by issuing more debt and pulling funding from various capital projects, including infrastructure improvements around the Horseshoe Casino.

Cincinnati yesterday laid down the first two streetcar tracks, putting the project on a clear path to completion after years of financial and political hurdles. The $133 million project is now expected to continue its construction phase over the next three years, with a goal of opening to the public on Sept. 15, 2016. City officials, including Mayor Mark Mallory and City Manager Milton Dohoney, celebrated the milestone and thanked supporters for remaining committed to the project. Meanwhile, former Councilman John Cranley, a streetcar opponent who’s running for mayor against streetcar supporter Vice Mayor Roxanne Qualls, criticized the city for laying down the tracks instead of delaying the project until a new mayor takes office in December. Cranley insists that he’ll cancel the project if he takes office, even though roughly half a mile of track will be laid out by then and, because of contractual obligations and federal money tied to the project, canceling the project at this point could cost millions more than completing it.
The Greater Cincinnati Homeless Coalition yesterday announced it’s suing the Hamilton County Sheriff’s Department over a new policy that attempts to remove homeless people from courthouse steps with the threat of arrest. The sheriff’s office says it still intends to redirect homeless people to housing and other services, but it told WVXU that clearing out the courthouse is necessary to invoke a “type of immediacy” to encourage homeless residents “to seek housing and a better situation.” Advocates call the policy dangerous and unfair. A press conference will be held later today to discuss the lawsuit.
State Senate President Keith Faber says he expects Gov. John Kasich’s proposal for a two-year, federally funded Medicaid expansion to gain approval from a seven-member legislative oversight panel known as the Controlling Board. Faber, a Republican who opposes the expansion, says it’s now time for the legislature to consider broader reforms for Medicaid, which provides health insurance to low-income and disabled Ohioans. After months of wrangling with legislators in his own political party to approve the expansion, Kasich, a Republican, on Friday announced he would bypass the legislature and instead ask the Controlling Board to approve federal funds to expand Medicaid eligibility to more low-income Ohioans for two years. The Health Policy Institute of Ohio previously found the expansion would generate $1.8 billion for Ohio and insure nearly half a million Ohioans over the next decade.

The streetcar project’s chances of survival grew on Thursday after Mayor John Cranley announced he’s willing to allow the $132.8 million project move forward if the annual operating costs for the streetcar are underwritten by private contributors.
But streetcar supporters might have as little as one week to provide assurances to Cranley that the operating costs can be underwritten by the private sector, given the federal government’s Dec. 20 deadline for up to $44.9 million in grants financing roughly one-third of the project.
Still, a representative of the Haile Foundation, a major private contributor to city projects, said private-sector leaders are already working on meeting Cranley’s offer and solving the issue.
The concern for Cranley — and even some streetcar supporters — is that annual operating expenses for the streetcar would hit the city’s already-strained operating budget, especially if the annual operating expenses are higher than the previous estimate of $3.4-$4.5 million.
Although the city wouldn’t need to pay for the full operating costs until the streetcar opens for service in 2016, Cranley and some council members are concerned finishing the project now would force the city to make payments it won't be able to afford in the future.
“We know the streetcar is a very expensive project,” Cranley said. “This community cannot afford a new, ongoing liability that goes on forever.”
Streetcar supporters argue Cranley’s view misses the streetcar’s potential for economic development, which could bring in more city revenues as more people move and work in the city.
The streetcar project would produce a 2.7-to-1 return on investment, according to a 2007 study from consulting firm HDR that was later verified by the University of Cincinnati.
Councilman Kevin Flynn, one of the two potential swing votes on council, said Cranley’s offer could provide “a way forward.” He previously told CityBeat that the operating costs remain a prominent concern for him because they could translate to cuts in the city’s budget, particularly to police and firefighters.
Eric Avner, vice president and senior program manager of community development at the Haile Foundation, called the deal “an olive branch” to streetcar supporters. He said he’s “very, very confident” the private sector will be able to find a solution.
“I don’t think we can solve it in a week. What I heard is he needs assurances,” Avner said.
Cranley said he doesn’t expect someone to come to city leaders next Wednesday with a check paying for 30 years of operating costs, but he said the commitment has to be serious and long lasting for the city to move forward with the streetcar.
Avner discussed bringing together a commission of private-sector leaders with some long-term assurances.
In what he described as an “organic” movement, Avner said he’s heard from various private-sector leaders that they want to keep the project going, but he claimed most of them don’t want to engage in a public “food fight” that could hurt their relations with the mayor and other city officials.
For Avner, it’s a matter of sticking to a project that’s already well into development and construction.
“We don’t have the luxury to waste that kind of money in this town,” he said.
Streetcar Project Executive John Deatrick on Nov. 21 told council members that canceling the streetcar project could save only $7.5-$24.5 million in capital costs after accounting for $32.8 million in estimated sunk costs through November, $30.6-$47.6 million in close-out costs and up to $44.9 million in federal grants that would be lost if the project were stopped.
After Cranley’s announcement, Councilwoman Yvette Simpson questioned Cranley’s motives and said the solicitation might be very difficult to meet in just one week.
Cranley said he’ll reach out to the Federal Transit Administration to try to get an extension, perhaps until the end of the year, on the deadline for federal grants.
“It’s obviously a huge, huge hurdle to try to pull this together in seven days,” Cranley said.
Cranley cautioned he wouldn’t be upset if his offer fell through. Flanked by union representatives for police, firefighters and other city workers, Cranley reiterated that his priorities still lie in basic city services.
Councilman P.G. Sittenfeld previously proposed setting up a special improvement district to pay for the operating costs. But Cranley called the approach unworkable because it would require property owners to opt in — an effort that would presumably take much longer than one week.
Cranley’s announcement came as streetcar supporters move to place a city charter amendment in support of the streetcar project on the ballot. The campaign vowed to gather 12,000 signatures by the end of the week.
While anti-urban Cincinnatians gripe over the twice-approved $95 million streetcar project — some going so far as to attach anti-funding amendments to federal bills that will never be included in the final legislation — authorities on the other side of the river are demonstrating just how little $20 million on transportation funding can provide. The state will widen KY 237 in Boone County using elevated ramps to allow for left-hand turns, adding a freeway-style element to the residential/corridor area. The two-year project will be paid for using Federal Surface Transportation Program funds.

Cincinnati City Council plans to move $29 million in funds to avoid further delays for the streetcar
project, but the city is still looking at a 2015 opening date. City officials announced Wednesday that a council
committee will vote Monday on three pieces of legislation to keep the
$110 million project in line with the recently announced delayed opening.
One measure would front $15 million to help Duke Energy move underground utility lines from the path of the proposed streetcar route. That money comes from the recent $37 million sale of land near the former Blue Ash Airport.
The city thinks it will get this money back once a dispute with Duke is resolved. The city contends that Duke is responsible for moving the lines, which the utility estimates will cost $18.7 million. Duke counters that the lines only have to be moved because of the streetcar construction, so the city should foot the bill.
“We’re fronting money for the Duke work until we can work out who pays for it with Duke,” city spokeswoman Meg Oldberding said. “It’s to keep the project on time and on budget. Delays would escalate the cost.”
Another ordinance would change the municipal code to “confirm the city’s existing rights” and clarify that utilities pay for the cost of relocating facilities unless otherwise negotiated, according to a news release.
Oldberding said Cincinnati has always maintained that it is the utility’s responsibility to relocate their facilities, so it is not a change in the city’s position.
The final ordinance would change the funding source that is repaying $25 million in bonds sold as part of the original plan to fund the streetcar.
Those bonds were originally being repaid with money coming into city coffers from southern downtown and the riverfront area.
That area wasn’t bringing in as much cash as expected, so the ordinance would have $14 million of the bonds repaid from a 1995 fund set up to collect service payments from the Westin/Star, Hyatt and Saks.
Oldberding said once the downtown district rebounds — it includes the Banks and the casino — it would repay the other fund.
The ordinances would not add to the project’s cost. Construction is scheduled to begin early next year.
Despite promising to
move on after he failed to cancel the $132.8 million streetcar
project, Mayor John Cranley continues criticizing the
project in interviews and social media.
Most recently, Cranley appeared on Local 12’s Newsmakers program and threatened
to eventually replace the Southwest Ohio Regional Transit Authority (SORTA)
board, which manages local Metro bus services, in response to board members’
defunct offer to take up streetcar operating costs. (City Council sets SORTA
appointments, not the mayor.)
“The fact is they were
willing to cannibalize bus service,” Cranley said,
contrary to SORTA’s insistence that their offer would not have affected bus
services. “I just felt that was a huge violation of what SORTA is supposed to
be about and what Metro is supposed to be about and what public transportation
is supposed to be about.”
Throughout the 24-minute
interview, Cranley referenced the
streetcar project when discussing the city’s parking meters and other subjects
— a continuation of repetitive anti-streetcar tactics Cranley
deployed on the campaign trail and in mayoral debates against former Vice Mayor
“I think the project is
wasteful and not worth the investment,” Cranley said
when asked about the project. “I think we would have been better off making the
hard decision to cut bait.”
Still, Cranley later added, “Obviously, since the supermajority of
council went against my wishes, I have to respect the process. So I’m not going
to try to sabotage the streetcar.”
The interview also
follows comments on social media. After the former head of the Cincinnati Art
Museum criticized the streetcar, Cranley tweeted on Dec. 27, “(N)ow some Orwellian commentators
will say art director not ‘progressive.’”
The continued anti-streetcar rhetoric comes despite promises to move on that Cranley made after Councilman Kevin Flynn announced he would provide the final vote needed to veto-proof City Council’s decision to continue the streetcar project.
“As I tell my son when he doesn’t get his way, it’s time to move on,” Cranley
said on Dec. 19.
heated rhetoric is nothing new in his campaign against the streetcar project.

marked a high level of confidence after voters elected a mayor and council

they projected that canceling the streetcar project would cost nearly as much as
completing it. Once again, Cranley’s comments proved
to be wrong — an independent audit found city officials were largely correct in
their assessment — but still showed the level of confident, heated rhetoric
that follows the mayor’s campaign against the streetcar project.
At the very least, Cranley’s rhetoric proves that while the policy debate over the streetcar is over for now, the public discussion is not. The question is whether the messaging will work as the project moves forward and the streetcar becomes a reality of Cincinnati.

In February, the U.S. unemployment rate fell to 7.7 percent, from 7.9 percent in January, and the nation added 236,000 jobs. Many of the new jobs — about 48,000 — came from construction, while government employment saw a drop even before sequestration, a series of across-the-board federal spending cuts, began on March 1. Economists seem quite positive about the report.
In January, Ohio’s unemployment rate rose to 7 percent, from 6.7 percent in December, with the number of unemployed in the state rising to 399,000, from 385,000 the month before. Goods-producing and service-providing industries and local government saw a rise in employment, while jobs were lost in trade, transportation, utilities, financial activities, professional and business services, leisure and hospitality, state government and federal government. In January, U.S. unemployment rose to 7.9 percent, from 7.8 percent in December.
A new report outlined renovations for the city-owned Tower Place Mall, which is getting a makeover as part of Cincinnati’s parking plan. A Hamilton County court ruled against the controversial traffic cameras in Elmwood Place, and the Ohio legislature is considering a statewide ban on the cameras. In his ruling, Judge Robert Ruehlman pointed out there were no signs making motorists aware of the cameras and the cameras are calibrated once a year by a for-profit operator. The judge added, “Elmwood Place is engaged in nothing more than a high-tech game of 3-card Monty. … It is a scam that motorists can’t win.” Bipartisan legislation was recently introduced to prohibit traffic cameras in Ohio.
JobsOhio, the state-funded nonprofit corporation, quietly got $5.3 million in state grants, even though the state legislature only appropriated $1 million for startup costs. JobsOhio says it needed the extra funds because legal challenges have held up liquor profits that were originally supposed to provide funding. In the past few days, State Auditor Dave Yost, a Republican, has been pushing Republican Gov. John Kasich and JobsOhio to release more details about the nonprofit corporation’s finances, but Kasich and JobsOhio have been pushing back.
Advocates for Ohio’s charter schools say Kasich’s budget amounts to a per-pupil cut, with funding dropping from $5,704 per pupil to $5,000 plus some targeted assistance that ranges from hundreds of dollars to nothing depending on the school. A previous CityBeat report on online schools found traditional public schools get about $3,193 per student — much less than the funding that apparently goes to charter schools.
